Shandong Bainong Sida Biotechnology Co., Ltd. ("BNSD") hereby issues the following formal statement on matters concerning its intellectual property rights.
I. Intellectual property statement
1. BNSD holds several invention patents, including: a preparation method for a water-dispersible granule containing pyraclostrobin and dimethomorph, patent No. ZL202210658871.7; a granulation device for fungicide preparation, patent No. ZL202210720423.5; and a drying system for powder pesticides, patent No. ZL202311330599.0.
2. BNSD holds several utility model patents, including: a mixer for water-dispersible granule production (ZL202121604674.4); a screw-stirring feeding device for dimethomorph production (ZL202121607575.1); a granulator for solid pesticides (ZL202020714105.4); a depolymerizing drying device for pesticide production (ZL202222132173.1); a drying system for water-dispersible granule pesticides (ZL202121984909.7); an airflow drying device for pesticide production (ZL202323147217.9); a vertical high-speed mixer for pesticide production (ZL202323096064.X); a wear-compensating granulator for water-dispersible granules (ZL202323013830.1); a vibrating screen for pesticide granule formulation production (ZL202320606398.8); an airflow pulverizer for pesticide powder preparation (ZL202320608336.0); a dehumidifying drying unit for solid pesticide formulations (ZL202320451839.1); and a mixing and stirring machine for pesticide powder processing (ZL202320523460.7).
3. BNSD and its affiliates have obtained pesticide registration certificates including PD20132340, PD20131105, PD20121603, PD20183011 and PD20160201.
BNSD has recently discovered that certain companies or individuals in the market are infringing its patents and other intellectual property rights, causing a seriously damaging impact. BNSD hereby solemnly declares:
1. Under the Patent Law of the People's Republic of China, no organization or individual may practice BNSD's patents without BNSD's authorization — that is, without a license, none may manufacture, use, offer to sell, sell or import the patented products; and, without a license, none may use the patented processes, or use, offer to sell, sell or import products obtained directly from such processes.
2. The companies concerned are requested to conduct an immediate self-inspection. Where any activity is suspected of infringing BNSD's patents, production and sales must stop at once, and necessary measures must be taken, including sealing inventory products and recalling products already sold.
3. Against any infringement of BNSD's intellectual property, the company will take legal action including, but not limited to, administrative complaints, civil litigation and criminal reports, to resolutely defend its lawful rights and interests.
